OCR PAR Issues Brochure - Special Opportunity Programs

A district may not categorically exclude LEP students from programs for the gifted and talented.

If a district has a process for locating and identifying gifted or talented students, it must also locate and identify gifted or talented LEP students who could benefit from the program.
Educational justifications for excluding any LEP student from such a program should be comparable to justifications used in excluding a non-LEP student.
